Under Federal Aviation Administration rules, the airline operator — not the cargo shipper — bears primary responsibility for a crash. In this case, that operator is 21 Air, a subsidiary that absorbed the operations of Atlas Air. Mary Schiavo, a transportation analyst and former inspector general of the U.S. Department of Transportation, drew a direct parallel to a fatal 2019 Amazon freighter accident in Texas, in which an Atlas Air 767 crashed into water. She litigated that case and noted the NTSB final report cited both the pilots and the company’s training program.
“Because Atlas was the operator, not Amazon Prime or Amazon Fulfillment, Atlas was liable and its insurers paid,” Schiavo said.
